Florida statutes were changed years ago and basically provide that if you’re 21 years old and over, you don’t have to wear a helmet. Under different kinds of circumstances, you’re supposed to wear a helmet. Whether you’re required to or whether you are not required to, it can affect your case. When we speak to motorcycle riders, we tell them to make sure you wear your helmet. It’s safe. If you don’t, your injuries will be worse. A jury likely will understand that you were not wearing your helmet and may hold that against you. It can hurt your case. It won’t eliminate your case.
