When you’re involved in an automobile accident case in northeast Florida or anywhere in Florida for that matter, you can always make a claim against the at fault driver. What’s important to know, though, is that if you have been injured, there must be insurance coverage with the at fault driver for us to be able to help you because the dollar amount of these cases typically are far more than what most people have in the way of assets. If they don’t have any insurance coverage and you don’t have uninsured motorist coverage or underinsured motorist coverage, which would pick up the difference, then we’re in all likely not going to be able to help you because it would be throwing good money after bad. We hate to have those conversations with clients but we do have them at the front end of the cases so that they’re aware that these circumstances do exist. The short answer is yes, you can make a claim, but the more complete answer is, if there’s no insurance to cover the loss, we probably won’t be able to help you.
